Permanent Injunction Issued on Overtime Rule
SEPTEMBER 8, 2017
Last week, a federal judge Texas struck down the Obama-era overtime rule. This ruling turns the preliminary injunction he had issued in November of 2016 into a permanent injunction.
The rule increased overtime for non-exempt employees to $913 per week ($47,476 per year) from $455 per week ($23,660 per year) and included automatic updates every three years. House Passes Workplace Flexibility Legislation

On May 2, 2017, the House of Representatives passed H.R. 1180, the Working Families Flexibility Act of 2017, which would permit private employers to provide employees compensatory (comp) time in lieu of overtime for hours worked by non-exempt employees over 40 hours in a work week. If enacted, employers could provide employees comp time at a rate not less than one and one-half hours for each hour of employment for which overtime compensation would otherwise be required. OSHA Rescinds Union Walk-around Letter

On April 25, 2017, the Occupational Safety and Health Administration (OSHA) withdrew a February 2013 letter of interpretation (LOI) that permitted union representatives to accompany OSHA inspectors on walk-around inspections at non-union workplaces. Congress Increases Apprenticeship Funding; Workforce Development Legislation Introduced

Last week, President Trump signed a $1 trillion omnibus spending bill that will keep the government running until September. Within the bill, funding for Workforce Innovation and Opportunity Act (WIOA) job-training grants remains steady at $2.7 billion, while federal appropriation for apprenticeships increased by $5 million, to $95 million.
